Terms of Use

Plain summary, which is not a substitute for the text below: the games here belong to the people who made them and we only embed them. The site is free, provided as it is, and we cannot promise a third-party game will work or behave. Everything else is detail.

1. Agreement

These terms are an agreement between you and StellarByte Tech, which operates Arcadoria at arcadoria.com ("the site", "we", "us"). By using the site you accept them. If you do not accept them, do not use the site.

2. What this service is

The site is a catalogue of browser games. We select games, write our own description, controls and tips for each one, group them into categories and collections, and embed them so you can play without downloading or registering anything.

We do not host, publish, develop or modify the games themselves. When you press Play, the game is loaded from the servers of the platform that distributes it and runs inside a frame on our page. There is no account system, no payment and nothing to install.

3. The games belong to their developers

Every game on this site — its code, artwork, audio, characters, titles and trademarks — is the property of its developer, publisher or their licensors. Nothing on this site transfers any right in a game to you or to us.

Games are embedded under distribution arrangements with the platforms that supply them, currently GamePix and GameMonetize. Their own terms govern the games and everything that happens inside the game frame: GamePix terms and conditions.

Two consequences follow, and we would rather state them than let you discover them:

  • We cannot fix a game. If a game is broken, saves your progress badly, or changes overnight, that is under the developer's and the platform's control. Tell us and we will chase it or drop the game, but we cannot patch it.
  • The advertising inside a game frame is not ours. It is how the developer is paid, and our agreements require that we neither block it nor cover it up. It is served by the platform, subject to the platform's policies.

4. What is ours

The editorial text on this site — the game descriptions, control summaries, tips and collection articles — plus the site's design, layout and code are ours and are protected by copyright.

You may read it, link to any page, and quote a short passage with attribution and a link. You may not republish it in bulk, or use it to populate another catalogue, with or without a machine in the loop. The editorial text is the only thing on this site that is genuinely ours, and it is the part we ask you to leave alone.

5. Acceptable use

You agree not to:

  • extract game URLs from this site in order to embed those games elsewhere, or strip, block or overlay the advertising inside a game frame for redistribution;
  • scrape or bulk-download the site, or hit it with automated traffic at a rate that affects other visitors;
  • frame, mirror or re-skin the site in a way that misrepresents whose site it is;
  • attempt to interfere with the site's operation, probe it for vulnerabilities, or use it to distribute malware;
  • use the site in a way that breaks the law where you are.

Ordinary use — playing games, bookmarking pages, sending a link to a friend — needs no permission and never will.

6. No accounts, no user content

There is no registration, no comment section and no upload facility, so there is no user-generated content on this site and no user obligations attached to it. This clause exists to say so explicitly rather than to leave the question open.

7. Availability and changes to the catalogue

The site is free and provided without any commitment to availability. We may add games, remove games, change categories or take the site down, without notice.

Games leave the catalogue regularly and usually not by our choice — publishers withdraw titles, and we remove anything that turns out to be broken or unsuitable. Where we can, a retired game's address redirects to its category rather than dead-ending.

8. No warranty

The site and the games are provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent the law where you are allows.

In particular we do not warrant that the site or any game will be uninterrupted, error-free, or free of harmful components, nor that any third-party game or advertisement will behave as it should. Our editorial content is written in good faith by people who have played the games, but games are updated by their developers and a description or control scheme may become out of date. If you find something wrong, tell us and we will correct it.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the site or of any game embedded on it, whether the claim is in contract, tort or otherwise, and whether or not we were advised such loss was possible.

Where liability cannot lawfully be excluded, our total liability to you for all claims arising out of the site is limited to one hundred US dollars (USD 100). The site is free, and this figure reflects that.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply to you only to the extent permitted, and nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.

10. Indemnity

You agree to indemnify us against claims, losses and reasonable legal costs arising from your breach of these terms or your misuse of the site.

11. Links and third-party services

The site links to and embeds services we do not control, including the game platforms, our advertising provider and our hosting provider. Their terms and privacy policies govern their services. A link is not an endorsement, and we are not responsible for third-party content. Which third parties are involved, and what each of them receives, is set out in full in our Privacy Policy.

12. Privacy

Our Privacy Policy forms part of these terms and explains what is collected, by whom, and what your options are.

13. Changes to these terms

We may revise these terms. The revised version is posted here with an updated date, and applies from the moment it is posted. If a change is material we will make that clear on this page rather than editing quietly. Continuing to use the site after a change means you accept the revised terms.

14. Governing law

These terms and any dispute arising out of them or out of your use of the site are governed by the laws of British Columbia, Canada, without regard to conflict-of-law rules. You and StellarByte Tech submit to the exclusive jurisdiction of the courts of British Columbia, Canada for any such dispute, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property.

If you are a consumer, this clause does not deprive you of the protection of the mandatory consumer law of the country in which you live.

15. General

  • Severability. If a provision is held unenforceable, the rest remains in force and the unenforceable provision is applied to the maximum extent permitted.
  • No waiver. Not enforcing a provision on one occasion is not a waiver of it.
  • Entire agreement. These terms and the Privacy Policy are the whole agreement between you and us about the site.
  • Assignment. You may not assign these terms. We may assign them in connection with a transfer of the site.
